Our offers and pricing
We offer services on this Website. The price of these services is as follows: The service provider is paying a percentage of each service revenue they complete thought the platform.. This price includes all applicable taxes and other fees.
Purchases
When you make a purchase on the Website, you will be using a third party payment processor, Moneris, that will collect your payment information and process your payment. We are not responsible for the collection, use, sharing or security of your billing information by Moneris. Cancellation policy

These Terms shall be governed and construed in accordance with the laws of Quebec, Canada, without regard to its conflict of laws provisions. These terms shall not be governed by the United Nations convention on contracts for the sale of international goods, the Uniform Commercial Code, nor Incoterms.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. Conditions d’utilisation pour les Fournisseurs de Services et Membres d’Équipe – Aidiway
1. Acceptation des conditions
En s’inscrivant ou en utilisant Aidiway, les fournisseurs de services et les membres d’équipe acceptent ces conditions, formant un accord juridique contraignant entre eux et Aidiway. Toute utilisation continue de la plateforme après des modifications implique l’acceptation des nouvelles conditions. Ces conditions doivent être lues en parallèle des conditions générales d’utilisation disponibles sur le site Web (https://www.aidiway.com/term-conditions), qui décrivent les règles générales d’utilisation des services Aidiway.
2. Admissibilité
Les fournisseurs et les membres d’équipe doivent être légalement autorisés à travailler au Québec et posséder toutes les certifications, licences ou qualifications nécessaires selon les réglementations locales. Vous devez être âgé de 18 ans ou plus ou avoir atteint l’âge de la majorité dans votre juridiction.
3. À propos du service
Aidiway fournit une plateforme permettant aux clients de trouver des fournisseurs de services et des membres d’équipe qualifiés. Aidiway n’offre pas directement ces services et ne supervise pas, ne gère pas et ne contrôle pas la qualité, les délais, la légalité ou tout autre aspect des services fournis par les fournisseurs et les membres d’équipe. Les fournisseurs sont seuls responsables de la qualité du service, de la conformité aux lois et du respect des normes d’Aidiway.
4. Communications électroniques
En utilisant la plateforme Aidiway, vous acceptez de recevoir des communications électroniques de la part d’Aidiway, telles que des courriels, appels, notifications et messages texte concernant les services, les mises à jour et les conditions d’utilisation. Ces communications remplissent toute exigence légale de communication écrite. Des frais standards de messagerie et de données peuvent s’appliquer. Les fournisseurs doivent respecter les conditions des magasins d’applications lors de l’utilisation de l’application Aidiway.
5. Responsabilités des fournisseurs et des membres d’équipe

Normes professionnelles: Les fournisseurs et les membres d’équipe doivent maintenir un haut niveau de professionnalisme, d’intégrité et de qualité lorsqu’ils utilisent la plateforme. Un comportement respectueux, courtois et réactif envers les clients est requis.

Exactitude du profil: Les fournisseurs et les membres d’équipe doivent s’assurer que leur profil, leurs qualifications et leurs certifications sont exacts et à jour. Toute fausse déclaration ou information trompeuse peut entraîner une résiliation immédiate.

Communication: Les fournisseurs et les membres d’équipe doivent répondre rapidement aux demandes des clients, aux réservations ou aux questions relatives aux services via la plateforme Aidiway. Une communication claire concernant la portée des services, les coûts et les délais est nécessaire pour maintenir la confiance.

Vérifications des antécédents: En s’inscrivant en tant que fournisseur ou membre d’équipe, vous acceptez qu’Aidiway effectue des vérifications d’antécédents ou des vérifications judiciaires dans le cadre du processus d’intégration. Toute inconduite ou violation de la confiance entraînera un retrait de la plateforme.
6. Responsabilités spécifiques aux membres d’équipe
Les membres d’équipe affiliés à un fournisseur ou une agence doivent:

Respecter les normes et politiques du fournisseur qu’ils représentent ainsi que celles d’Aidiway.

Être autorisés par le fournisseur ou l’agence à agir en son nom, notamment en ce qui concerne la prestation de services et la communication.

Ne pas créer de comptes de fournisseurs indépendants sans autorisation écrite d’Aidiway.
7. Règles spécifiques aux services sur la plateforme

Les fournisseurs qui acceptent des demandes de services via la plateforme Aidiway doivent respecter les conditions indiquées dans les détails de la réservation.

Les fournisseurs doivent informer à la fois le client et Aidiway de tout retard, annulation ou problème imprévu affectant la prestation des services dans les meilleurs délais.

Une mauvaise gestion des réservations, des annulations répétées ou le non-respect des attentes des clients selon les détails de la réservation peuvent entraîner des pénalités ou une suspension de compte.

Les fournisseurs doivent respecter les directives spécifiques à la plateforme en matière de services, de délais et de coûts.
8. Paiements et frais

Traitement des paiements: Aidiway utilise des processeurs de paiement tiers pour gérer tous les paiements. Les fournisseurs sont responsables de la configuration d’un mode de paiement vérifié pour recevoir leurs paiements.

Frais de service: Aidiway facture aux utilisateurs des frais pour chaque transaction et applique un pourcentage aux fournisseurs pour les services complétés. Les frais applicables aux utilisateurs sont affichés sous la section "Taxes" avant la confirmation d’une réservation, tandis que le pourcentage appliqué aux fournisseurs est visible dans leur profil.

Paiement des membres d’équipe: Les membres d’équipe sont rémunérés selon l’accord conclu avec le fournisseur ou l’agence. Aidiway n’est pas responsable des différends de paiement entre les fournisseurs et les membres d’équipe.

Conditions de paiement des services: Tous les paiements doivent être effectués via la plateforme Aidiway, et les fournisseurs ne doivent pas solliciter de paiements en dehors de la plateforme. Solliciter des paiements en dehors de la plateforme constitue une violation de ces conditions.
9. Frais minimums et annulations
Aidiway se réserve le droit d’imposer des frais minimums ou des frais d’annulation aux fournisseurs qui annulent des services planifiés sans raison valable afin d’assurer l’engagement envers les clients et la fiabilité de la plateforme.

Annulation par les fournisseurs: Des annulations fréquentes sans raison valable peuvent entraîner des pénalités, une suspension ou une résiliation de compte.

Annulation par les clients: Les clients peuvent annuler leurs réservations en fonction de la politique d’annulation du fournisseur. Les fournisseurs sont encouragés à proposer des conditions d’annulation flexibles afin d’améliorer la satisfaction des clients.

Substitution de fournisseurs: Dans certaines circonstances, Aidiway se réserve le droit de remplacer un fournisseur si celui-ci n’est pas en mesure de compléter le service. Les fournisseurs qui ne respectent pas les standards de service peuvent perdre leur rémunération pour la réservation.

Résiliation: Aidiway se réserve le droit de suspendre ou de résilier les comptes des fournisseurs ou des membres d’équipe en cas de non-respect de ces conditions, de violation du code de conduite, des lois du Québec ou des normes de la plateforme.
10. Conformité aux lois du Québec
Les fournisseurs et membres d’équipe doivent:

Se conformer à la Charte de la langue française en s’assurant que tous les services et communications avec les clients peuvent être réalisés en français.

Respecter les lois sur la protection de la vie privée, notamment la Loi sur la protection des renseignements personnels dans le secteur privé, et garantir la sécurité des données des clients.

Respecter les normes d’emploi applicables lors de l’embauche ou de la sous-traitance des membres d’équipe, y compris la classification appropriée des travailleurs (contractuels ou employés).
11. Stockage des données et propriété intellectuelle

Aidiway se réserve le droit d’établir des pratiques générales concernant l’utilisation et le stockage des données sur la plateforme, y compris la conservation des communications entre fournisseurs et clients.

Aidiway n’est pas responsable de la suppression ou de l’échec du stockage des informations et communications sur la plateforme.

Les fournisseurs doivent respecter les politiques d’utilisation des données d’Aidiway afin de garantir une communication transparente et conforme avec les clients.
12. Assurance et responsabilité

Les fournisseurs doivent maintenir une assurance responsabilité professionnelle et toute autre assurance applicable couvrant leurs services et les risques associés. Une preuve d’assurance peut être exigée par Aidiway.

Aidiway n’est qu’un intermédiaire technologique et n’assume aucune responsabilité pour la prestation des services. Toute réclamation ou litige entre le client et le fournisseur/membre d’équipe doit être résolu directement entre eux.
13. Rétroaction et suggestions
En fournissant toute rétroaction ou suggestion concernant la plateforme Aidiway, vous accordez à Aidiway le droit de les utiliser, modifier et distribuer sans compensation.
14. Assurance et responsabilité

Exigence d’assurance: Les fournisseurs doivent maintenir une assurance responsabilité professionnelle ainsi que toute autre couverture d’assurance applicable à leurs services et aux risques associés. Une preuve d’assurance peut être exigée par Aidiway.

Responsabilité d’Aidiway: Aidiway agit uniquement en tant que plateforme intermédiaire et n’assume aucune responsabilité quant à la prestation des services. Toute réclamation, plainte ou responsabilité liée aux services fournis relève des clients et des fournisseurs ou membres d’équipe. Les fournisseurs doivent s’assurer que leur assurance couvre tout dommage ou toute responsabilité potentielle.

Assurance des travailleurs: Les fournisseurs doivent s’assurer qu’ils respectent les exigences locales en matière d’assurance pour les travailleurs et couvrent les membres de leur équipe, si applicable.
15. Indemnisation
Les fournisseurs et membres d’équipe acceptent d’indemniser, défendre et dégager de toute responsabilité Aidiway, ses filiales, dirigeants, employés et représentants en cas de réclamations, responsabilités, dommages, pertes et frais (y compris les frais juridiques) découlant de:

Toute violation des présentes conditions par le fournisseur ou le membre d’équipe.

Tout acte, omission ou inconduite du fournisseur ou du membre d’équipe dans l’exécution des services.
-
Toute réclamation de clients ou de tiers concernant des blessures, dommages ou pertes liées aux services fournis par le biais d’Aidiway.
-
Toute violation des lois locales, règlements ou droits de tiers par le fournisseur ou le membre d’équipe.
16. Droits d’auteur, propriété intellectuelle et plaintes relatives au contenu
Si vous pensez qu’un contenu présent sur la plateforme Aidiway enfreint vos droits d’auteur, votre marque de commerce ou d’autres droits de propriété intellectuelle, ou si vous trouvez du contenu inapproprié, veuillez suivre les étapes suivantes:

Votre plainte doit inclure:

- Une preuve de votre propriété intellectuelle ou une déclaration expliquant pourquoi le contenu viole les droits d’Aidiway ou des tiers.

- Vos coordonnées (adresse, téléphone, courriel).

- Une déclaration sous peine de parjure affirmant que votre demande est faite de bonne foi et que le contenu n’est pas autorisé par le détenteur des droits.
2. Réponse et actions: Aidiway examinera la plainte et se réserve le droit de supprimer ou de désactiver l’accès au contenu concerné, en informant le fournisseur, membre d’équipe ou client impliqué.
3. Politique de récidive: Aidiway peut suspendre ou résilier les comptes de fournisseurs, membres d’équipe ou clients qui enfreignent à plusieurs reprises des droits de propriété intellectuelle ou publient du contenu inapproprié.
17. Conduite des utilisateurs et activités interdites
Les fournisseurs sont strictement interdits d’utiliser la plateforme Aidiway pour solliciter des clients en dehors de la plateforme, recruter pour des plateformes concurrentes ou s’engager dans des activités illégales. Toute violation peut entraîner une résiliation immédiate du compte.
18. Crédits promotionnels
Aidiway peut offrir des crédits promotionnels aux clients afin de favoriser leur engagement sur la plateforme. Les fournisseurs reconnaissent que ces crédits ne sont pas échangeables contre de l’argent et ne constituent pas une forme de rémunération.
19. Résolution des différends
Aidiway propose un service de médiation pour aider à résoudre les conflits entre clients, fournisseurs et membres d’équipe. Toutes les parties doivent tenter une résolution à travers le processus de médiation d’Aidiway avant d’entreprendre toute action légale. Toute action légale intentée doit être menée dans la juridiction du Québec.
20. Non-contournement
Les fournisseurs et membres d’équipe conviennent que toutes les transactions avec les clients trouvés via la plateforme doivent être effectuées sur Aidiway. Il est interdit aux fournisseurs d’effectuer des transactions directement avec les clients d’Aidiway en dehors de la plateforme pendant une période d’un an suivant la fin du premier service complété. Toute violation de cette clause peut entraîner des sanctions, y compris une suppression du compte.
21. Prescription légale
Toute réclamation liée aux présentes conditions ou à l’utilisation de la plateforme Aidiway doit être déposée dans un délai d’un an à compter de la date à laquelle la réclamation est survenue, faute de quoi elle sera définitivement prescrite.
22. Fusion ou acquisition
En cas de fusion, acquisition ou vente d’Aidiway, les présentes conditions peuvent être transférées à l’entité successeur. L’utilisation continue de la plateforme après un tel transfert constitue une acceptation des nouvelles conditions.
23. Interprétation
Les titres des sections des présentes conditions sont fournis à titre indicatif et ne doivent pas affecter leur interprétation. Les mots au singulier incluent le pluriel, et inversement. Toute mention de "y compris" doit être interprétée comme "y compris, mais sans s’y limiter".
24. Modifications

Providers and crew members must be legally eligible to work in Quebec and possess all necessary certifications, licenses, or qualifications as per local regulations. You must be 18 years or older or meet the majority age in your jurisdiction.

Aidiway provides a platform that connects clients seeking services with qualified providers and crew members. Aidiway does not directly provide the services and does not oversee, manage, or control the quality, timing, legality, or any aspect of the services provided by providers and crew members. Providers are solely responsible for service quality, compliance with laws, and adherence to Aidiway’s standards.

Electronic Communications
By using the Aidiway platform, you consent to receive electronic communications from Aidiway, such as emails, calls, notifications and text messages from Aidiway regarding services, updates, and terms. These communications fulfill any legal requirements for written communication. Standard messaging and data rates may apply. Providers must adhere to app store and platform terms when using the Aidiway app.

Provider and Crew Member Responsibilities

Professional Standards: Providers and crew members must maintain high levels of professionalism, integrity, and quality while using the platform. A respectful, courteous, and prompt demeanor when dealing with clients is required.

Profile Accuracy: Providers and crew members must ensure that their profiles, credentials, and qualifications are accurate and up to date. Misrepresentation, falsifying information, or misleading clients is grounds for immediate termination.

Communication: Providers and crew members must respond promptly to client inquiries, bookings, or service-related queries via the Aidiway platform. Clear communication regarding the scope of services, costs, and timing is required to maintain trust.

Background Checks: By registering as a provider or crew member, you consent to Aidiway conducting background checks or criminal record checks as part of the onboarding process. Misconduct or breaches of trust will result in removal from the platform.

Crew Member-Specific Responsibilities
Crew members associated with a provider or agency must:

Uphold the standards and policies of both the provider they represent and Aidiway.

Be authorized by the provider or agency to act on their behalf, especially in terms of service delivery and communication.

Not create independent provider accounts unless authorized in writing by Aidiway.

Platform-Specific Service Rules

Providers must notify both the client and Aidiway of any delays, cancellations, or unforeseen issues affecting service delivery promptly.

Mismanagement of bookings, repeated cancellations, or non-compliance with client expectations as per booking details may result in account penalties or suspension.

Providers must adhere to platform-specific guidelines for setting expectations about the service's scope, timing, and costs.

Payments and Fees

Payment Process: Aidiway uses third-party payment processors to handle all payments. Providers are responsible for setting up a verified payment method to receive payouts.

Service Fee: Aidiway charges users a service fee for each transaction and a percentage fee to providers for completed services. The user’s fee will be displayed under the "Taxes" section before confirming any booking, while the provider's percentage is visible in their profile.

Crew Member Payment: Crew members will be compensated as per the arrangement made with the provider or agency. Aidiway is not responsible for disputes regarding payment between providers and crew members.

Service Payment Terms: All payments must be processed through the Aidiway platform, and providers must not solicit payment outside of the platform. Soliciting payments outside the platform is a violation of these terms.

Minimum Charges and Cancellations
Aidiway reserves the right to impose minimum charges or cancellation fees on providers who cancel scheduled services without valid reasons. This ensures commitment to clients and maintains platform reliability.
Cancellation, Refunds, and Termination:

Cancellation by Providers: Repeated cancellations without a valid reason can result in penalties, account suspension, or termination. Providers must strive to maintain a reliable and trustworthy service record.

Client Cancellations: Clients may cancel bookings based on the provider's cancellation policy. Providers are encouraged to offer flexible cancellation terms to enhance customer satisfaction.

Substitution of Providers: In certain circumstances, Aidiway reserves the right to substitute another provider if it deems that the original provider is unable to complete the service. Providers who fail to meet service standards may forfeit their compensation for the booking.

Termination: Aidiway reserves the right to suspend or terminate the accounts of providers or crew members for non-compliance with these terms, or any violation of the Code of Conduct, Quebec laws, or platform standards.

Compliance with Quebec Laws
Providers and crew members must:

Comply with Quebec’s Charter of the French Language, ensuring that all services offered and communication with clients can be conducted in French.

Adhere to privacy laws, such as the Act Respecting the Protection of Personal Information in the Private Sector, ensuring secure handling and protection of client data.

Follow all relevant employment standards when employing or subcontracting crew members, including proper worker classification (independent contractors or employees).

General Practices Regarding Use and Storage

Aidiway reserves the right to establish general practices and limits for the use and storage of data on the platform, including data retention for provider and client communications.

Aidiway is not liable for the deletion or failure to store any information or communications maintained on the platform, including service logs, messages, or feedback.

Providers must comply with Aidiway’s data use policies to ensure transparency and proper communication with clients through the platform.

Intellectual Property and Confidentiality

Intellectual Property: Providers and crew members must protect any confidential information shared by Aidiway or clients. Aidiway owns all rights to platform-related content and branding. Providers and crew members may not use Aidiway’s intellectual property for personal gain without written permission.

Confidentiality: Providers must respect the confidentiality of all client information obtained during service delivery. Unauthorized disclosure or misuse of client data may result in legal action and termination from the platform.

Feedback or Suggestions
By providing any feedback or suggestions regarding the Aidiway platform, you grant Aidiway ownership of these submissions, allowing Aidiway to use, modify, and distribute them for any purpose without compensation to you.

Insurance and Liability

Insurance Requirement: Providers are required to maintain professional liability insurance and any other applicable insurance to cover their services and any associated risks. Providers must supply proof of insurance upon request.

Aidiway's Liability: Aidiway is a platform provider and does not assume any liability for service delivery or performance. Any disputes, claims, or liabilities arising from services rendered fall between the client and the provider/crew member. Providers are solely responsible for ensuring that their insurance covers potential damages or liabilities.

Worker's Compensation: Providers must ensure they comply with any local requirements for workers’ compensation insurance, covering their crew members where applicable.

Indemnification
Providers and crew members agree to indemnify, defend, and hold harmless Aidiway, its affiliates, directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in connection with:

Any breach of these terms by the provider or crew member.

Any act, omission, or misconduct by the provider or crew member in the course of delivering services.

Any claims by clients or third parties for injury, damage, or loss related to the services provided by the provider or crew member through the Aidiway platform.

Any violation of local laws, regulations, or third-party rights by the provider or crew member.

Copyright, Intellectual Property, and Content Complaints
If you believe that any content on the Aidiway platform infringes upon your copyright, trademark, or other intellectual property rights, or if you find any content objectionable or inappropriate, please follow the steps outlined below:

Response and Action: Upon receiving a valid complaint, Aidiway will investigate the issue and reserves the right to remove or disable access to the content in question, notifying the provider, crew member, or client involved.

Repeat Offender Policy: Aidiway may terminate the accounts of providers, crew members, or clients who repeatedly infringe intellectual property rights or post objectionable content.

User Conduct and Prohibited Activities
Providers are expressly prohibited from using the Aidiway platform to solicit clients for off-platform transactions, recruit for competing platforms, or engage in any unlawful activities. Violation of this clause may result in immediate termination from the platform.

Promotional Credits
Aidiway may issue promotional credits to clients to encourage platform engagement. Providers acknowledge that such credits are non-redeemable as cash and do not serve as a form of provider compensation.

Dispute Resolution
Aidiway offers mediation services to assist with disputes between clients, providers, and crew members. Both parties must attempt resolution through Aidiway's dispute process before seeking external legal action. Any legal action taken must be within Quebec’s jurisdiction.

Non-Circumvention
Providers and crew members agree that all transactions with clients they connect with through the platform must be conducted on Aidiway. Providers are prohibited from engaging in direct transactions with Aidiway clients outside the platform for a period of one year after the completion of the initial service. Violation of this non-circumvention clause may result in penalties, including removal from the platform.

Statute of Limitations
Any claim related to these terms or the use of the Aidiway platform must be filed within one year from the date the claim arose, or it will be permanently barred.

Merger or Acquisition
In the event of a merger, acquisition, or sale of Aidiway, these terms may be transferred to the successor entity. Your continued use of the platform following such a transfer constitutes your acceptance of the updated terms.

Interpretation
The headings in these terms are for convenience only and will not affect the interpretation of the terms. Words in the singular include the plural, and vice versa. References to "including" should be interpreted as "including, without limitation.

Aidiway may update these terms at any time, providing prior notice. Continued use of the platform after updates implies consent to the new terms.

Governing Law
These terms are governed by the laws of Quebec and applicable federal laws. Any disputes will be handled within the province's jurisdiction.
